Special Assessment District No. 2250 Update

The West Fargo City Commission will hold a special meeting to hear written appeals for District No. 2250 special assessments at 5:30 p.m. Thursday, Oct. 6, in the Commission Chambers of West Fargo City Hall. District No. 2250 is a street improvement district for the reconstruction of Sheyenne Street from Beaton Drive to 40th Avenue W. that is partially funded through special assessments. Information about the special assessment district is available at https://www.westfargond.gov/1021/Special-Assessment-Projects. They will hold a second special meeting at 5:30 p.m. Thursday, Oct. 13, to take action on any written appeals previously filed.  

A notice of the Oct. 6, meeting and appeal opportunity was published in the legal section of The Forum on Sept. 21, 2022. Individuals with property within the improvement district who object to the allocations have an opportunity to file a written appeal for this hearing. . Those who submit a written appeal by 5 p.m. Thursday, Oct. 6, are able to present during the meeting.

To file an appeal, a property owner must submit it in writing to Tina Fisk, City Administrator (cityauditor@westfargond.gov or Attn: Special Assessment Protest, 800 4th Ave. E., West Fargo, ND 58078). The appeal must be in writing and include the names of all owners of the property, the property’s address and reference the improvement district being appealed. Property owners who previously submitted an objection to the Special Assessment Commission must submit a new written appeal to the West Fargo City Commission. 

At the conclusion of the meeting, the West Fargo City Commission will determine if any action needs to be taken to adjust the special assessment allocation. They will revisit the district at 5:30 p.m. Thursday, Oct. 13, 2022, to take final action on the matter. This meeting will be open to the public to attend and observe, but not for public comment. 

If a landowner disagrees with the decision of the West Fargo City Commission, they may appeal to Cass County district court. Following the confirmation of the special assessment list, the amount due can be paid without interest for 10 days. After the 10 days, the balance due is subject to interest.
